Mutation Of Property !

There are 2 types of land which require Mutation :

 

  • Agricultural Land.
  • Any type of land or built up property.

Mutation means permanent change and in terms of property it means change of ownership as per Government records. Generally revenue records or Municipal Corporation.

Now let’s us understand Mutation Of Property in detail.

Basically mutation can be done for the agricultural land or the other type of land or residential land/commercial land/Office space/built up properties but in different ways.

Now in such cases ownership transfer can be done through sale deed, gift deed, transfer to legal heir, will, exchange deed or transfer deed.

But just getting these documents registered is not enough for the transfer of ownership. So let’s see the ownership transfer in both the cases :

 

Agricultural Land ;

Negotiation of Sale price : there will be a negotiation of sale price between buyer and seller.

Agreement to sell : then an Agreement to Sell with all the details of the property will be made.

Sale Deed : a Registered Sale Deed will be made.

Mutation : it is final step in the transfer of ownership and it is very important as the name of owner changes in Government revenue records which are different in different States. So only after mutation only the final ownership transfer takes place.

Other Land and Built up property ;

Negotiation of sale price : there will be a negotiation of sale price between buyer and seller.

Agreement to Sell : then an Agreement to Sell with all the details of the property will be made.

Sale Deed : in such case Sale Deed is considered to be the final step in ownership transfer and it is not necessary to get the revenue records updated.

Mutation : you need to get the records updated in the Municipal Corporation just for fulfilling the purpose of property taxes. In such cases the purpose doesn’t involve ownership transfer.

 

Why Is Mutation Important ?

Agricultural Land :

 

  • It acts as an ownership proof.
  • It helps to avoid fraud since property gets registered in Government records.
  • It eases the process of Government compensation.

 

Other Land or Built up property :

 

  • For property tax purposes.
  • Not a proof of ownership.

Documents Required for Mutation :

 

  • Copy of Registered Sale Deed.
  • Application for Mutation.
  • Indemnity bond on Stamp Paper.
  • Affidavit on Stamp Paper.
  • Receipt of Up do date payment of Property tax.
  • Copy Of Power Of Attorney (if applicable).
